The Platform is not insurance and is not a substitute for insurance. Nothing on the Platform is intended to be, and should not be understood as, a substitute for professional medical, legal, financial, or insurance advice. You should always seek the advice of a qualified professional with any questions you may have regarding a medical condition, a treatment decision, or an insurance or coverage decision. Never disregard professional advice or delay seeking it because of something you saw or read on the Platform. If you are experiencing a medical emergency, call your local emergency number immediately; do not use the Platform to seek emergency assistance.

2What the Platform Does; No Guarantee of Outcome

The Platform is built to help you make healthcare decisions with greater clarity, speed, and confidence — including by organizing pricing, plan, and provider information so you can compare options more efficiently. The specific tools, comparisons, and information available through the Platform may change over time, and we may add, modify, or discontinue any feature at our discretion.

Information displayed on the Platform, including pricing, plan details, and provider information, is compiled from a variety of sources, including pharmacies, insurers, providers, and other third parties, and is provided for your convenience. We do not guarantee that any price, plan detail, provider recommendation, or other information displayed on the Platform is accurate, complete, or current, or that it will match what you are ultimately charged or offered by a pharmacy, insurer, or provider. You should independently confirm any pricing, coverage, or provider information directly with the relevant pharmacy, insurer, or provider before making a decision or a purchase.

Use of the Platform does not guarantee any particular outcome, including that you will find a lower price, a better plan, or a suitable provider, that any discount or offer will be honored, or that any inquiry you submit will be answered or acted upon by us or by a third party. Where the Platform connects you with a third-party pharmacy, insurer, provider, or other partner, that third party — and not Jaspari — is responsible for the services, pricing, and decisions it provides to you.

3Eligibility to Use the Platform

The Platform is intended for individuals who are 18 years of age or older, or the age of legal majority in their jurisdiction, and who reside in the United States or its territories. You may use the Platform to submit your own information only if you meet this requirement and have the legal capacity to do so, or, where you are acting on behalf of a family member or dependent, only if you are authorized to do so on their behalf. You represent that any information you submit, whether about yourself or about another person you are authorized to act for, is accurate to the best of your knowledge.

4Your Information

By submitting information through the Platform — including through a pricing search, plan comparison, or lead or quote form — you authorize us to use that information to provide the requested feature or service, and, where applicable, to share it with the relevant pharmacy, insurance, or partner organization in order to fulfill your request, consistent with our Privacy Policy. You are responsible for the accuracy and completeness of any information you submit, and Jaspari is not responsible for decisions made in reliance on inaccurate or incomplete information you provide.

5Communications; SMS Consent and Opt-Out

If you submit your telephone number through the Platform, you consent to receive text messages from Jaspari at that number regarding your submission and related account or inquiry communications. Message frequency varies depending on your activity. Message and data rates may apply. Consent to receive text messages is not a condition of using the Platform.

You may opt out of receiving further text messages at any time by replying to any message we send you with any of the following keywords: STOP, UNSUBSCRIBE, END, QUIT, or CANCEL. Once we receive one of these keywords, we will send you a one-time confirmation that you have been unsubscribed, and we will not send you further messages unless you opt back in as described below. You may opt back in and resume receiving messages by replying with any of the following keywords: START, UNSTOP, YES, or SUBSCRIBE.

Carriers are not liable for delayed or undelivered messages. By submitting your telephone number, you also consent to receive calls from Jaspari at that number regarding the same subject matter described above. When you register or communicate with us electronically, you are communicating with us electronically and you consent to receive communications from us electronically, including by email and text message; you agree that any agreement, notice, disclosure, or other communication we provide to you electronically satisfies any legal requirement that it be in writing.

6Acceptable Use

You agree to use the Platform only for lawful, personal, non-commercial purposes. You agree not to:

• provide false or misleading information
• submit another person’s information without appropriate authorization
• attempt to access any part of the Platform not intended for you
• interfere with or disrupt the operation or security of the Platform
• use any automated means to access, scrape, or extract data from the Platform without our prior written consent
• copy, modify, distribute, sell, or create derivative works from any part of the Platform or its content, except as expressly permitted by these Terms
• use the Platform in any way that violates applicable law

7Ownership; Limited License

The Platform, including its design, text, graphics, and other content (collectively, "Content"), is owned by Jaspari LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content for your own personal, non-commercial use. This license does not include any right to resell or make commercial use of the Platform or its Content, or to use any data mining, extraction, or similar tools on the Platform. All rights not expressly granted to you in these Terms are reserved by Jaspari LLC. Information you submit through the Platform remains subject to our Privacy Policy and is not Content for purposes of this Section.

8Third-Party Trademarks and Content

References on the Platform to pharmacies, insurers, providers, drug manufacturers, or other third parties, and any of their names, logos, brands, trademarks, or other proprietary marks displayed on the Platform, are the property of their respective owners. Such references are used solely to identify the relevant company, product, or service for informational and comparison purposes and do not imply any affiliation, sponsorship, or endorsement by, or of, Jaspari, unless expressly stated. Nothing on the Platform grants you any right or license to use a third party’s name, logo, brand, or trademark for any purpose.

9Third-Party Content, Partners, and Links

The Platform may contain, reference, or link to content or information from third parties, including pharmacies, insurers, providers, and other partners, as well as third-party websites or services. We do not control and are not responsible for the content, accuracy, availability, or practices of any third party, and a reference or link does not imply our endorsement of it. Any transaction, communication, or relationship you enter into with a third party referenced through the Platform is solely between you and that third party, and you access or engage with it at your own risk and subject to that third party’s own terms and privacy practices.

10Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, including where we believe in good faith that you have violated these Terms, provided false or misleading information, or used the Platform in a way that could harm Jaspari, a partner, another individual, or the integrity of the Platform. You may stop using the Platform at any time. You may request that we delete the personal information associated with your use of the Platform by contacting us as described in our Privacy Policy. Sections 1, 2, and 7 through 17 of these Terms survive any termination of your use of the Platform.

11Disclaimer of warranties

The Platform and its Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Jaspari disclaims all warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Jaspari does not warrant that the Platform will be uninterrupted, timely, secure, or error free, or that any information on the Platform, including pricing, plan, or provider information, is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the foregoing exclusions may not apply to you.

12Limitation of liability

To the fullest extent permitted by applicable law, Jaspari will not be liable to you for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of opportunity, arising out of or relating to your use of, or inability to use, the Platform, or any information, referral, or connection made through the Platform, even if Jaspari has been advised of the possibility of such damages. The Platform is provided to you free of charge, and you do not pay Jaspari to use the Platform; accordingly, Jaspari’s total liability to you for any claim arising out of or relating to these Terms or the Platform will not exceed zero dollars ($0). Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the foregoing limitations may not apply to you, in which case Jaspari’s liability will be limited to the fullest extent permitted by applicable law. Nothing in this Section 12 limits any liability that cannot be limited or excluded under applicable law.

13Indemnification

You agree to indemnify, defend, and hold harmless Jaspari LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, your violation of applicable law, or information you submit through the Platform about yourself or another person, except to the extent caused by Jaspari’s gross negligence or willful misconduct.

14Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will provide notice by updating the "Last Updated" date above and, where appropriate, through the Platform or by other reasonable means. Your continued use of the Platform after a change becomes effective constitutes your acceptance of the updated Terms. If you do not agree to a change, you must stop using the Platform.

15Governing Law

These Terms are governed by, and will be construed in accordance with, the laws of the State of Delaware, without regard to its conflict of laws principles.

16Dispute Resolution and Arbitration

You and Jaspari agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be administered in the State of Delaware by a single arbitrator. You and Jaspari each waive any right to a jury trial and to participate in a class action, class arbitration, or other representative proceeding, and any claim must be brought in an individual capacity only. Each party will bear its own costs of arbitration except as the arbitrator may otherwise award. If applicable law in your jurisdiction prohibits mandatory arbitration or a class action waiver as applied to you, this Section 16 will not apply to you to that extent, and the applicable portion of Section 15 will govern instead.

17General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. No failure or delay by Jaspari in exercising any right under these Terms will operate as a waiver of that right. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of some or all of our assets. Nothing in these Terms creates any partnership, joint venture, or agency relationship between you and Jaspari. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jaspari regarding your use of the Platform and supersede any prior agreements or understandings on that subject.
